• We Can Hope: Illegal Immigrant Killer May Face Some Justice After All

    Surge Summary: An illegal immigrant who killed a San Francisco woman is poised to be set free after a state firearm charge against him was overturned. The Feds are stepping in to try to keep that from happening.

    It has to be one of the most galling outrages against justice to take place in recent memory; but, happily, some recompense might be in the offing.

    An immigration watchdog was pleased to learn this week that a federal prosecutor will pursue criminal charges against an illegal alien who was acquitted of a 2015 murder.

    The last day of August, a California appeals court reversed a conviction for felony possession of a firearm against Jose Inez Garcia-Zarate.  U.S. Attorney David Anderson announced last week his office will be pursuing federal gun charges against him.

    Garcia-Zarate, a five-time deported illegal from Mexico, kicked off fierce debate over illegal immigration after he shot and killed a woman, Kate Steinle, on a popular San Francisco pier.

    It was later learned that Garcia-Zarate should have been handed over to ICE agents, since it had issued a detainer for him, but the liberal city’s “sanctuary policy” allowed him to go free despite a drug warrant that had placed him in a county jail cell. He was released in April and shot Steinle on July 1 on Pier 14, using a .40 caliber pistol that had been stolen from the vehicle of a Bureau of Land Management ranger days earlier.

    Garcia-Zarate’s defense attorneys argued their client had accidentally fired the stolen pistol and Steinle was killed when a single round ricocheted off concrete and struck her in the back.

    However, a spokesman for the Federation of American Immigration Reform, Ira Mehlman, insists accusatorily it wasn’t just the illegal alien who is responsible for the thirty-two-year-old woman’s death.

    “It was all the politicians,” he says, “who made the policies that put him out on the pier in the first place.”

    U.S. attorney Anderson admits to Fox News it’s not presently clear what consequences the Mexican national will face for these new charges.

    “There is a chance for at least some measure of justice,” Anderson hopes. Then he drives home what ought to be one of this travesty’s most crucial lessons. “But it is justice in a case that never should have happened in the first place.”

    Fox News relates Garcia-Zarate has faced a succession of serious state charges – hold on to your seat! — not just first-degree murder but also second-degree murder, involuntary manslaughter, and assault with a weapon.

    Anyone detecting a pattern here?

    The jury acquitted him of ever charge except felony possession – and that conviction was just overturned.

    Basic human decency demands some price must be paid for the unjustifiable killing of Kate Steinle while she was strolling on the San Francisco waterfront. No doubt some technical explanation is being proffered to rationalize illegal immigrant Garcia-Zarate’s walking on Steinle’s death, never mind all these other charges. It might satisfy some onlookers. But it transparently should not satisfy those who care about maintaining the integrity of U.S. borders and the value of innocent life.
